AviNat Terms of Use (End User License Agreement)
Last updated: October 7, 2026
These Terms of Use ("Terms") are an agreement between you and SUCCESS SAT FZC LLC (trading as AviNat) (A-63-00-01-10, Flamingo Villas, Ajman, United Arab Emirates) ("AviNat", "we", "us"). They cover the AviNat app for iPhone and the services behind it (together, the "Service"). By creating an account or using AviNat, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use AviNat.
1. Who can use AviNat
- You must be at least 13 years old, or older if the law where you live requires it. In the European Economic Area, the United Kingdom and other places where the age of digital consent is higher (up to 16), you must be at least that age, or have the consent of a parent or guardian where local law allows it.
- You must be allowed to use the Service under the laws that apply to you, including sanctions and export laws.
- You need a mobile phone number that can receive a sign-in code (by WhatsApp, Telegram or SMS). You must give a number that you are allowed to use.
- You are responsible for your device and your account. Keep your device locked and do not share your sign-in codes. AviNat will never ask you for a code.
2. Your account
- Your account is tied to your phone number. You can sign in on your own devices; each new sign-in needs a code sent to your number.
- Keep your profile information accurate. Do not pretend to be another person or organization.
- You can log out of a device at any time, and you can delete your account in the app under You > Account > Delete account. What deletion removes is explained in our Privacy Policy. Deleting your account does not cancel an AviNat Pro subscription (see section 6).
3. Privacy and encryption
- Your messages and normal voice and video calls are end-to-end encrypted. We cannot read or listen to them.
- Some features are not end-to-end encrypted and are clearly labelled in the app: translated calls, public and private channels, profile photos and profile information you make visible, and custom contact names you save in AviNat. Our Privacy Policy explains how each is handled.
- Because messages are end-to-end encrypted, we cannot recover messages for you. If you lose your device without a chat backup, or lose your backup password or key, your message history may be lost permanently.
4. Acceptable use
You may use AviNat only for lawful, personal or business communication. You must not, and must not try to:
- Break the law, or help anyone else break it, including laws on privacy, intellectual property, consumer protection, sanctions, and data protection.
- Share content that sexually exploits or endangers children, in any form. We report such content to the authorities where the law requires it.
- Threaten, harass, bully, stalk or intimidate anyone, or encourage violence, terrorism or self-harm.
- Share hateful content that attacks people for who they are (for example race, ethnicity, religion, disability, gender, sexual orientation or national origin).
- Share sexual content of a person without their consent, or sexual content in a public channel.
- Send spam, bulk or automated messages, chain messages or unsolicited advertising; create accounts in bulk or by automated means; or buy, sell or rent accounts or phone numbers.
- Commit fraud, phishing or scams, or impersonate another person, AviNat or any organization.
- Share malware or try to gain unauthorized access to the Service, other accounts, devices or networks.
- Reverse-engineer, scrape, overload, interfere with, or circumvent security, rate limits or encryption of the Service, except where the law gives you a right to do so that cannot be waived.
- Infringe anyone's copyright, trademark or other rights.
- Use a translated call to record, translate or process another person's voice without any consent the law requires where you are.
Reporting and blocking. You can block any person, and you can report a person, a message or a channel from inside the app. We review reports and act on content that breaks these Terms, normally within 24 hours. Because messages are end-to-end encrypted, we only see what a reporter chooses to send us with a report.
Our response. If you break these Terms, we may remove content we host (for example channel posts), restrict features, suspend or ban your account, and preserve information where the law requires it.
5. Your content
- You keep ownership of what you send and post ("your content"). You are responsible for it.
- To run the Service, you give us a worldwide, non-exclusive, royalty-free licence to store, transmit, re-encode (for example resize a profile photo) and deliver your content, only as needed to provide the Service. For end-to-end encrypted content we only ever handle the encrypted form.
- Channel owners and admins are responsible for what is posted in their channels, and for moderating them.
- Chat media is kept on our servers for a limited time. Photos, videos, voice messages and documents sent in chats stay on our servers for up to 30 days so recipients can download them, and are then deleted from our servers. Copies already saved on devices stay there. Keep your own copies of anything important.
6. AviNat Pro (subscription) and minute credits
AviNat's normal messages and calls are free. AviNat Pro is an optional paid subscription for translated calls.
Price and billing.
- AviNat Pro is an auto-renewing monthly subscription sold through Apple's App Store. The price is shown in the app before you buy, in your local currency (in the United States, US$15.99 per month). Taxes are handled by Apple.
- Payment is charged to your Apple Account when you confirm the purchase.
- The subscription renews automatically each month at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription in your Apple Account settings (iPhone Settings > [your name] > Subscriptions) or from You > AviNat Pro > Manage subscription. If you cancel, Pro stays active until the end of the period you paid for.
- Deleting the AviNat app or your AviNat account does not cancel your subscription. Only you can cancel it in your Apple Account.
- If we change the price, Apple will tell you in advance and, where required, ask for your consent.
What Pro includes.
- 150 translated-call minutes per monthly billing period. Unused minutes expire at the end of each period and do not carry over.
- Only the person who starts a translated call uses minutes. The person you call does not need Pro.
- Every started minute counts. A call under 10 seconds of active translation is not charged.
- If your minutes run out during a call, translation pauses and the call itself continues.
Minute credits (extra minutes).
- Only active AviNat Pro subscribers can buy minute credits.
- Credits are one-time purchases (consumable in-app purchases) in packs of 45, 90, 180, 270, 450, 900 or 1,800 minutes, at the prices shown in the app.
- Each purchase expires 5 months after the date you bought it. Expired credits are lost and are not refunded.
- Your monthly Pro minutes are used first, then credits, starting with the credits that expire soonest.
- Credits you have already bought remain usable until they expire, even if your Pro subscription ends.
- Credits have no cash value, cannot be transferred to another account or person, and cannot be exchanged.
Refunds. All payments are processed by Apple. We cannot issue refunds ourselves. You can ask Apple for a refund at reportaproblem.apple.com; Apple decides under its own policies. If Apple refunds a credit purchase, the unused minutes of that purchase are removed.
Free trials. There is no free trial at launch. If we offer one later, its terms are shown before you subscribe.
Restoring purchases. On a new or reinstalled iPhone signed in to the same Apple Account, use Restore purchases on the AviNat Pro page. Pro follows your Apple subscription. If you restore on a different AviNat account, Pro and its remaining monthly minutes move to that account.
Availability. Translated calls may not be available in every country, language or for every account, and we may change the languages offered.
Supported languages. AviNat Pro is offered for the languages listed in the app at the time you subscribe: one list for voice and video translation (each language with AviNat's own accuracy guide: top, medium or lower) and one for text translation (some marked Beta). The lists are on the AviNat Pro page and in the subscribe screen, and can be searched before you buy.
- Before you subscribe, the app asks you to confirm that you have reviewed these lists and that they include the languages you need, and that you understand translation is provided by an AI partner, may contain mistakes, and that translated chats and calls are not end-to-end encrypted.
- Languages that are not listed are not included in AviNat Pro. The accuracy labels and Beta marks are a rough guide, not a promise of quality for any conversation.
- Language support is listed as of the day you see it and may change; we may add, relabel or remove languages.
- This confirmation is an acknowledgement and informed consent only. It does not limit any right you have to ask Apple for a refund, or any right you have under the consumer law that applies to you.
7. Translated calls
- A translated call is a separate call that is not end-to-end encrypted. The app tells you this before every translated call, and both people must agree (the caller taps Start, the other person taps Answer).
- During a translated call, both people's voices are sent through our servers to our AI partner, a third-party service that converts speech to speech and text in real time. Our Privacy Policy names it.
- Translation is produced automatically and can make mistakes. It can mistranslate, miss or repeat words, or detect the wrong language. Do not rely on translated calls for medical, legal, financial, emergency or other situations where a mistake could cause harm. Use a normal (end-to-end encrypted) call for private conversations.
- Translated calls have a maximum length and can stop if the translation service is unavailable.
8. Third-party services
AviNat relies on Apple (App Store, push notifications, iCloud Keychain for backup keys) and other providers described in the Privacy Policy. Your use of Apple's services is also governed by Apple's terms. Links you open from chats or channels lead to sites we do not control.
9. Changes to the Service and these Terms
We are continually improving AviNat and may add, change or remove features. We may update these Terms. If a change is material, we will tell you in the app or by another reasonable means before it takes effect. If you keep using AviNat after the change takes effect, you accept the updated Terms. If you do not agree, stop using AviNat and delete your account.
10. Termination
- You can stop using AviNat at any time and delete your account in the app.
- We may suspend or end your access, immediately where reasonable, if you break these Terms, if the law requires it, or to protect users, the Service or others. Where appropriate and lawful, we will tell you and give you a way to appeal by writing to [email protected].
- If we stop offering the Service entirely, we will give reasonable notice where possible.
- Sections 5 (licence ends, but content already delivered stays with recipients), 11, 12, 13 and 14 survive termination.
11. Disclaimers
AviNat is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including fitness for a particular purpose, merchantability and non-infringement. We do not promise that the Service will be uninterrupted, error-free or that messages, calls, media or backups will always be delivered or kept. AviNat is not a replacement for emergency services and cannot be used to call emergency numbers.
12. Limitation of liability
To the fullest extent the law allows, AviNat and its directors, employees and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us (through Apple) in the 12 months before the claim, or (b) US$100. Nothing in these Terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, fraud, or your statutory rights as a consumer.
13. Indemnity
If you are using AviNat for a business, you agree to compensate us for claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms or your content, to the extent the law allows.
14. Governing law and disputes
These Terms are governed by the laws of the United Arab Emirates, and the courts of the Emirate of Ajman, United Arab Emirates have jurisdiction, without affecting any mandatory rights you have under the consumer laws of the country where you live.
15. Apple-specific terms (required by Apple for a custom EULA)
- These Terms are between you and AviNat only, not Apple. Apple is not responsible for the app or its content.
- The licence we grant you is a limited, non-transferable licence to use AviNat on Apple-branded devices you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the app. To the maximum extent the law allows, Apple has no other warranty obligation.
- AviNat, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims.
- If a third party claims the app infringes its intellectual property, AviNat, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Questions, complaints and claims about the app go to us: [email protected], A-63-00-01-10, Flamingo Villas, Ajman, United Arab Emirates.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16. General
- These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
- If a part of these Terms cannot be enforced, the rest stays in effect.
- If we do not enforce a right, we do not give it up.
- You may not transfer these Terms to anyone else. We may transfer them as part of a merger, acquisition or sale of assets, with notice to you.
